End-User License Agreement

1. Grant of License
You have a limited right to use Griz on Apple devices you own.
Subject to the terms and conditions of this End-User License Agreement ("EULA") and the Terms of Service, Poppies Studios grants you a limited, non-exclusive, non-transferable license to use Griz on Apple-branded devices (iPhones, iPads) that you own or control, for your personal, non-commercial use only.
2. Scope of License
You can use Griz personally; you cannot resell, modify, or redistribute it.
This license permits you to download and install Griz from the Apple App Store on your personal devices, use the Service as described, and make a single backup copy for personal use. This license does NOT permit you to copy, modify, or create derivatives; reverse-engineer, decompile, or disassemble; remove copyright notices; use unlawfully; scrape or crawl; abuse infrastructure; resell; or use competitively.
3. Ownership & Intellectual Property
Poppies Studios owns Griz. You own your data.
Griz, including all artwork, design, code, functionality, and content, is the exclusive property of Poppies Studios and is protected by copyright and trademark laws. Your use does not grant you any ownership interest. You retain ownership of any screenshots, messages, or text you submit to Griz. By submitting content, you grant us a license to process and use that content solely to provide the Service.
4. Apple's Role as Third-Party Beneficiary
Apple is a third-party beneficiary of this EULA and may enforce its terms.
You acknowledge and agree that Apple, Inc. is a third-party beneficiary of this EULA and has the right to enforce any term or condition herein. Apple is not a party to this EULA and has no obligation to furnish any maintenance, support, or other services related to Griz.
5. Warranty Disclaimer
Griz is provided as-is. We make no guarantees.
GRIZ IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. POPPIES STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NEITHER POPPIES STUDIOS NOR APPLE WARRANTS THAT GRIZ WILL MEET YOUR EXPECTATIONS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
6. Limitation of Liability
Our liability is limited. Apple has no liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POPPIES STUDIOS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Damage to personal relationships or reputation resulting from AI suggestions
- Unauthorized access to or alteration of your transmissions or data
THE LIABILITY OF POPPIES STUDIOS SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID FOR GRIZ IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER. APPLE HAS NO LIABILITY WHATSOEVER FOR GRIZ.
7. Indemnification
You agree to defend us if your use of Griz causes problems.
You agree to indemnify, defend, and hold harmless Poppies Studios and Apple from any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to your use, violation of this EULA or any law, content you submit, or infringement of third-party rights.
8. Product Claims & Responsibility
Poppies Studios is responsible for product issues, not Apple.
Poppies Studios is solely responsible for any product claims related to Griz, including product liability claims, warranty claims, and claims that Griz fails to conform to any applicable legal or regulatory requirement. Apple assumes no responsibility for investigating, defending, settling, or paying any claims that arise from Griz.
9. Consumer Protection & Regulatory Compliance
Poppies Studios, not Apple, is responsible for compliance with consumer protection laws.
Poppies Studios is responsible for compliance with all applicable consumer protection laws, privacy laws, data protection regulations (including GDPR and CCPA), and any other legal requirements related to Griz. Apple has no such responsibilities.
10. Termination
We can revoke your license at any time.
Poppies Studios may terminate this license at any time if you violate any term of this EULA or the Terms of Service, or for any other reason. Upon termination, you must uninstall Griz and cease all use. Provisions that by their nature should survive termination shall survive.
11. Governing Law
This EULA is governed by California law.
This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
Note to lawyer: Confirm California law is appropriate before publication. Alternative: Delaware or New York law.
12. Entire Agreement
This is the complete agreement for Griz's license.
This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Poppies Studios regarding Griz and supersedes all prior or contemporaneous agreements, understandings, and negotiations, whether written or oral.
13. Severability
If any part is invalid, the rest remains in effect.
If any provision of this EULA is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
14. Waiver
Failure to enforce a right doesn't mean we've given it up.
The failure of Poppies Studios to enforce any right under this EULA does not constitute a waiver of that right or any other right.
